Terms of Service

The agreement between you and Momeza when you create, host, or join an event.

Agreement

These terms are an agreement between you and Stylianos Karydakis (“Momeza”, “we”). By creating an account, hosting an event or joining one, you agree to them. If you use Momeza on behalf of an organisation, you accept them for that organisation as well.

Please read them alongside our Privacy Policy, which explains how we handle your data.

Who can use it

You must be at least 16 years old to hold a Momeza account. Everyone who takes part in an event needs one — hosting, joining, uploading a photo or answering an RSVP all require signing in, however you arrived, including from a scanned QR code.

You are responsible for your account and for keeping your password to yourself. Tell us promptly if you think someone else has got into it.

Using Momeza

You may use Momeza to create, host, and join events. Hosts set the rules for their own events — who is invited, what may be shared, and how long content stays available within the limits of their plan.

Hosting means responsibility for your guests: for inviting them, for what you allow to be shared, and for the fact that deleting your event takes everything in it away from them too.

Your content

You keep ownership of everything you upload. You grant Momeza only the limited licence needed to store, process, and display your content within your event — nothing more. That licence ends when the content does.

We never claim ownership of your memories, and we never use them for advertising or to train models. Upload only what you have the right to upload, and be careful with photographs of people who have not agreed to be in them.

Acceptable use

Don’t upload unlawful, harmful, or infringing content, don’t harass anyone, and don’t attempt to disrupt the service, probe it, or reach data that isn’t yours.

Hosts and Momeza may remove content or suspend accounts that break these rules. Serious or repeated abuse may end your access.

Payment

Plans are bought per event, and every fee is shown before you pay. Storage durations and what each plan includes are described on the pricing page. Prices include tax where it applies.

Who sells you the plan depends on where you buy it. On this website, payments are taken by Polar, acting as merchant of record: Polar is the seller on your receipt, handles the tax, and is who your card details go to — they never reach us. In the Momeza apps for iOS and Android — which are not released yet — the purchase is made through Apple's App Store or Google Play, who are the seller for that transaction and whose terms apply to it.

That is also why the two prices can differ. Apple and Google set the price for each country from their own tier tables and add local tax themselves, so the figure in the app is the one you will be charged there — and it is not always the euro price shown on the pricing page.

A plan that keeps a gallery alive renews monthly until you cancel it, and cancelling takes effect at the end of the period you have paid for.

Refunds and cancellation

If you are a consumer in the EU or UK, you normally have 14 days to withdraw from a purchase. Because a paid event plan is digital content that starts working immediately, you are asked to agree that it begins straight away — and that right ends once it has, to the extent the plan has been used.

Outside that, if something goes wrong — the service failed, the plan was not what the pricing page described, you were charged twice — tell us and we will put it right. Statutory rights that cannot be waived are unaffected.

A plan bought inside the iOS or Android app is refunded by the store that sold it, not by us: Apple and Google handle those requests through your account with them, and we cannot reverse a charge we never received. Tell us anyway if something went wrong — we can usually fix the event itself while the store deals with the money.

Ending it

You can delete your account at any time from Settings → Data. It is immediate and permanent: it removes your events and everything inside them, for your guests as well as for you. Export first if you want to keep anything.

We may suspend or close an account that breaks these terms, or withdraw the service entirely — in which case we will give reasonable notice, and refund the unused part of a paid plan.

Liability

Momeza is provided with care, but as-is. We work hard to keep the service available and your content safe, yet we can’t promise it will be uninterrupted or entirely error-free — and Momeza is young software, which is worth weighing before you make it the only record of an important night.

To the extent the law allows, we are not liable for indirect or incidental losses, and our total liability is limited to what you paid us for the event in question. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot be limited by law.

Governing law

These terms are governed by the law of Cyprus, and disputes go to its courts. If you are a consumer, you keep the protection of the mandatory law where you live, and may bring a claim in your own courts.

EU consumers can also use the European Commission’s online dispute resolution platform. We would rather you wrote to us first — most things are quicker to fix than to argue about.

Changes

We may update these terms as Momeza evolves. When changes are material, we will let you know in advance through the app or by email.

Continuing to use Momeza after an update means you accept the revised terms. Questions are welcome through our contact page.
